Terms of Service & Legal Notice

1. Acceptance of Terms

By accessing and using the Gard API services, you agree to be bound by these Terms of Service. If you do not agree to these terms, you must not use our services. These terms apply to all users, visitors, and clients of the Gard API platform, including individuals and legal entities.

2. No Refunds — Final Sale

All purchases made through Gard API — including credit packages, API keys, subscription fees, and any other services — are final and non-refundable. Once a transaction is completed, no refunds will be issued under any circumstances, including but not limited to: insufficient credits, technical issues, dissatisfaction with service quality, change of mind, or failure to achieve desired results through the API. All sales are considered final. We recommend reviewing our pricing and documentation carefully before making any purchase.

3. Service Description

Gard API provides an API gateway for AI-powered music generation (Suno AI, Heavo AI) and music distribution services (ZVONKO Digital). We act as an intermediary and proxy between our users and third-party services. We do not guarantee specific results from generated content, nor do we guarantee uninterrupted or error-free service. Our services may be modified, suspended, or discontinued at any time without prior notice.

4. User Responsibilities

You are solely responsible for: (a) maintaining the confidentiality of your API keys and account credentials; (b) all activities that occur under your account; (c) ensuring your use of our services complies with all applicable laws and regulations; (d) not using our services for any illegal, fraudulent, or infringing purpose; (e) not reverse-engineering, decompiling, or attempting to extract source code from our services; (f) not using automated tools to abuse our APIs or bypass rate limits.

5. Content and Intellectual Property

Content generated through our services (music tracks, lyrics, etc.) is subject to the terms and conditions of the underlying AI models and third-party services. You are responsible for ensuring that your use of generated content complies with applicable intellectual property laws. Gard API does not claim ownership of content you generate, but we also cannot guarantee that your generated content will not infringe on third-party rights. You agree to indemnify and hold harmless Gard API from any claims arising from your use of generated content.

6. Limitation of Liability

To the maximum extent permitted by law, Gard API shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, use, goodwill, or other intangible losses. Our total liability for any claim arising from or related to these terms or our services shall not exceed the amount you have paid to us in the twelve (12) months preceding the claim. We do not warrant that our services will meet your requirements or be available on an uninterrupted, secure, or error-free basis.

7. Data and Privacy

We collect and process personal data in accordance with our Privacy Policy. By using our services, you consent to the collection and processing of your data as described. We may collect: account information, API usage data, billing information, and technical data (IP addresses, browser information). We do not sell your personal data to third parties. 8. Account Termination

We reserve the right to suspend or terminate your account at any time, with or without notice, for any reason including but not limited to: violation of these terms, suspicious activity, non-payment, or at our sole discretion. Upon termination, you will lose access to all account data and services. Any outstanding credits or payments will not be refunded upon termination.

9. Governing Law and Dispute Resolution

These terms shall be governed by and construed in accordance with applicable laws. Any disputes arising from or in connection with these terms shall be resolved through negotiation and, if necessary, through the competent courts of the jurisdiction where the service provider is registered. You agree to attempt to resolve any disputes through good-faith negotiation before pursuing legal action.

10. Changes to Terms

We reserve the right to modify these terms at any time. Changes will be effective immediately upon posting on this page. Your continued use of the services after changes are posted constitutes acceptance of the modified terms. We encourage you to review these terms periodically. If you do not agree with any changes, you must stop using our services immediately.
